Terms of Service
1. Introduction
Welcome to Phoenix Plumbing LLC. These Terms of Service (“TOS”) govern the provision of plumbing services by Phoenix Plumbing LLC to our customers. By requesting and using our services, you agree to these terms. If you do not agree with these terms, please do not engage our services.
2. Scope of Services
Phoenix Plumbing LLC provides plumbing services and HVAC services, including but not limited to repairs, installations, maintenance, and inspections. All services will be performed in a professional and workmanlike manner according to industry standards. The scope of work for each project will be defined in a separate service agreement or work order.
Exclusions: Unless explicitly stated, our services do not include remediation of hazardous materials, such as asbestos or mold, and work beyond the agreed-upon scope.
3. Estimates and Quotes

Estimates: We provide estimates based on the information available at the time. Estimates are valid for 30 days unless otherwise noted. Final costs may vary due to unforeseen circumstances or additional work required.

Quotations: Fixed-price quotations will be provided where possible and include labor, materials, and any applicable taxes. Any additional work requested by the customer will be billed separately.

There is a consultation fee which is waived if the work we recommend to be done is completed. If recommended service is denied by customer consultation fee will be invoiced.
4. Pricing and Payment Terms

Pricing Structure: Charges will include labor, materials, travel time, and any additional fees for emergency or after-hours services. Pricing details will be provided in the estimate or service agreement.

Payment Terms: Payment is due upon completion of services unless otherwise agreed upon in writing. We accept cash, checks, credit cards, etc..

Late Payments: Payments not received within 30 days of the invoice date are subject to a [1.5%] late fee per month or the highest amount permitted by law.
5. Cancellation and Rescheduling Policy

Cancellation: Customers may cancel scheduled services by providing at least 24 hours’ notice. Cancellations within this period may incur a cancellation fee of $50.00

Rescheduling: Customers may reschedule without penalty if done 24 hours in advance. We will make every effort to accommodate your new requested time.
6. Warranty and Guarantees

Labor Warranty: We provide a 1-year warranty on labor. If defects in workmanship arise during this period, we will repair the issue at no additional cost.

Material Warranty: Materials used are subject to manufacturer warranties. We will assist in facilitating claims where applicable.

Exclusions: Warranty does not cover misuse, alterations by the customer, or damage caused by other contractors.
7. Liability and Limitations

Limited Liability: Phoenix Plumbing LLC is not liable for indirect, incidental, or consequential damages arising from our services. Our liability is limited to the amount paid for the specific service provided.

Third-Party Products: We are not responsible for the failure or performance of third-party products not supplied by us.
8. Access and Customer Responsibilities

Access Requirements: Customers are responsible for providing safe and adequate access to the work area. This includes moving personal property and ensuring pets and children are kept away during service.

Utilities: Customers must provide access to water, electricity, and any necessary permits or documentation.
9. Health and Safety
Phoenix Plumbing adheres to all health and safety regulations. We require customers to maintain a safe environment and comply with any safety instructions provided by our staff.
10. Permits and Compliance

Permits: Customers are responsible for obtaining any required permits unless otherwise agreed upon. We will advise on necessary permits and can assist in the application process upon request.

Compliance: All work will comply with local building codes and regulations.
11. Termination of Services

By the Company: Phoenix Plumbing LLC reserves the right to terminate services for non-payment, unsafe working conditions, or breach of these TOS.

By the Customer: Customers may terminate services at any time; however, payment is due for all work completed up to the date of termination.
12. Dispute Resolution

Mediation: In the event of a dispute, both parties agree to first attempt resolution through mediation.

Arbitration: If mediation fails, disputes will be resolved through binding arbitration in Milford, PA, governed by the laws of Pennsylvania.
13. Privacy Policy
Data Collection: We collect personal information necessary to perform our services and handle transactions. Your data will not be shared with third parties without your consent, except as required by law.
Security: We use appropriate security measures to protect your information.
14. Amendments to Terms
Phoenix Plumbing LLC reserves the right to update or amend these TOS at any time. Changes will be posted on our website or communicated directly to customers.
